Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and BowlRz ("BowlRz", "we", "us", or "our") governing your use of the BowlRz website, mobile app, and related services (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you use the Services on behalf of a business (such as a bowling center), you represent that you are authorized to act for that business and to bind it to these Terms.

2. Your account

You access the Services through BowlRz ID. You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, reverse-engineer, resell, or create derivative works of the Services except as permitted by law.

4. Acceptable use

You agree not to:

  • Break the law, infringe others' rights, or violate these Terms;
  • Upload content that is unlawful, infringing, deceptive, harassing, hateful, or harmful;
  • Misrepresent your identity or your authority over a center;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
  • Scrape, harvest, or use the Services to build a competing dataset without permission; or
  • Attempt to manipulate, jailbreak, or misuse AI-assisted features.

5. Your content

You retain ownership of the content you submit (such as center details, photos, and posts). You grant BowlRz a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content as needed to operate and promote the Services (including publishing a center's website). You are responsible for your content and represent that you have the rights to share it.

6. Centers and third-party content

The Services include information about bowling centers and links to third-party content and websites. We do not guarantee the accuracy of center-provided or third-party information and are not responsible for third-party services.

7. Paid features and subscriptions

Some owner features are offered as paid plans or subscriptions. Prices and features are described at the point of purchase. Subscriptions renew automatically until cancelled, and you authorize recurring charges through the applicable payment processor. You may cancel before the next renewal to avoid further charges; except where required by law, payments are non-refundable. If you purchase through the Apple App Store, billing, renewals, and refunds are handled by Apple under the App Store Terms, and you manage or cancel the subscription in your Apple account settings.

8. Intellectual property

The Services, including software, design, and the BowlRz marks, are owned by BowlRz and its licensors and are protected by intellectual-property laws. Except for the license granted to you, we reserve all rights.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOWLRZ AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100.

11. Indemnification

You agree to indemnify and hold BowlRz harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms or the law.

12. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Services. Sections that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws rules. The courts located in Oregon will have exclusive jurisdiction, except where applicable law provides otherwise.

14. Changes

We may update these Terms. We will post the updated version and revise the "Last updated" date; continued use after changes means you accept them.

15. Apple App Store — additional terms

The following terms apply when you obtain the BowlRz app through the Apple App Store ("App Store Sourced Application"). They are required by Apple and apply in addition to the Terms above.

  • Acknowledgement. These Terms are between you and BowlRz only, not Apple. BowlRz, not Apple, is solely responsible for the app and its content.
  • Scope of license. The license granted to you is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Maintenance and support. BowlRz is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support.
  • Warranty. BowlRz is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Product claims. BowlRz, not Apple, is responsible for addressing any claims relating to the app or your use of it, including (i) product-liability claims, (ii) any claim that the app fails to conform to a legal or regulatory requirement, and (iii) claims arising under consumer-protection, privacy, or similar legislation.
  • Intellectual property rights. In the event of any third-party claim that the app or your use of it infringes that third party's intellectual-property rights, BowlRz, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
  • Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints, or claims regarding the app should be directed to BowlRz at [email protected].
  • Third-party terms. You must comply with applicable third-party terms of agreement when using the app.
  • Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
